All persons, including the Developer, the Board, Members and Owners, their respective families, visitors, guests, tenants, employees, service providers, contractors and occupants enter the Reserve and utilise any facility thereon at their own risk at all times.

Persons entering, including the Developer, the Board, Members and Owners, their families, visitors, guests, tenants, employees, service providers, contractors and occupants hereby waive any right they may obtain against the Association and/or Developer to claim any damage incurred by virtue of damage to or loss of property or the personal injury of the person occasioned while anywhere in the Reserve.

Persons entering, including the Developer and every Member/Owner indemnifies the Association against any such claim made by the Developer’s,  and/or Member’s/Owner’s spouse, child, parent, servant, visitor, guest, tenant, service provider, contractor, occupants or invitee.

It remains the Developers’ and Members’/Owners’ respective obligation to bring the Developer’s and Member’s/Owner’s spouse, child, parent, servant, visitor, guest, tenant, service provider, contractors, occupants or invitee’s attention to the Rules and Code of Conduct, as well as the indemnity as set out in this clause.

The Developer and Members/Owners, as applicable, will be held liable for any and all transgressions of the Rules and Code of Conduct by its family members, guests, visitors, friends, tenants, employees, service providers and contractors.
